1. Agreement to Terms

By accessing or using Tekora NMS (“the Platform”), operated by Tekora (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Tekora NMS is a cloud-based network monitoring platform that provides real-time monitoring, alerting, reporting, and management capabilities for network infrastructure. The Platform is available through subscription plans with varying features and limits as described on our pricing page.

3. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized access to your account
  • One organization may have multiple users as permitted by your subscription plan
  • You are responsible for all activity that occurs under your account

4. Subscription Plans & Billing

  • Subscriptions are billed monthly on a recurring basis
  • All prices are in USD and exclude applicable taxes
  • You may upgrade or downgrade your plan at any time — changes take effect on your next billing cycle
  • Downgrading may result in loss of access to certain features and data retention periods
  • We reserve the right to modify pricing with 30 days' written notice
  • Refunds are not provided for partial months of service

5. Free Plan

The Free plan is available at no cost with limited features. We reserve the right to modify Free plan limitations at any time. Free plan accounts inactive for more than 90 days may be subject to data deletion after prior notice.

6. Acceptable Use

You agree not to:

  • Use the Platform to monitor networks you do not own or have authorization to monitor
  • Attempt to gain unauthorized access to other users' data or accounts
  • Use the Platform to conduct vulnerability scanning against unauthorized targets
  • Reverse engineer, decompile, or disassemble the Platform
  • Resell or redistribute the Platform without an Enterprise/MSP agreement
  • Use the Platform in any way that violates applicable laws or regulations
  • Exceed the usage limits of your subscription plan through automated means

7. Data Ownership

  • Your data is yours. You retain all ownership rights to network data, configurations, and reports generated through the Platform
  • You grant us a limited license to process your data solely to provide the service
  • You may export your data at any time through our API or reporting features
  • Upon account termination, you have 30 days to export your data before permanent deletion

8. White-Label & Custom Branding

Enterprise plan customers may customize the Platform with their own business name, logo, colors, and branding (“White-Label Features”). When using White-Label Features:

  • You may display your business name alongside or in place of the TekoraOne brand within the dashboard
  • You are responsible for ensuring your branding does not infringe on third-party intellectual property
  • The underlying platform technology remains the property of Tekora
  • White-Label branding does not transfer any intellectual property rights to the Platform

9. API Usage

Access to the Tekora NMS API is subject to rate limits defined by your subscription plan. API keys are your responsibility to protect. We reserve the right to throttle or disable API access if usage patterns indicate abuse or excessive load.

10. Service Availability

We strive to maintain 99.9% platform availability. However, we do not guarantee uninterrupted service. Planned maintenance windows will be communicated in advance. Enterprise customers with SLA agreements are governed by the terms of their specific SLA.

11. Limitation of Liability

To the maximum extent permitted by law, Tekora shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Platform. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim. The Platform is a monitoring tool — we are not liable for network outages, security incidents, or data loss on your monitored networks.

12. Termination

  • You may cancel your subscription at any time — your access continues until the end of the current billing period
  • We may suspend or terminate your account for violation of these Terms with prior notice where possible
  • Upon termination, your right to use the Platform ceases immediately
  • Data export is available for 30 days post-termination

13. Governing Law

These Terms are governed by the laws of the State of Florida, United States. Any disputes shall be resolved in the courts of Miami-Dade County, Florida.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
